RECOGINK エンドユーザー使用許諾契約

このソフトウェア使用許諾契約（「ライセンス」）は、 RecogInk ソフト ("RecogInk") 向けに、(個人または一つの団体）と RecogInk Solutions S.P.R.L. ("RECOGINK SOLUTIONS") 間に定められた法的契約書で、パソコンソフト、関連メディア、印刷したマテリアル、および、「オンライン」または電子文書を対象とします。
RecogInkおよび付随する文書のインストール、コピー、または使用する場合は、本契約書の定める条件に制約されるものとします。

本契約書の条件に同意できない場合は、RecogInkのインストールおよび使用を禁じることとします。

I.    使用許諾の付与
 
このライセンスでは、以下の権限が付与されます。

A.    インストールおよび使用方法。RECOGINK SOLUTIONS grants you a limited, non-exclusive, non-transferable, royalty-free license to install and use RecogInk on one computer. Except as provided in Section IV(C) with respect to Additional Software Components, RECOGINK SOLUTIONS reserves all title, copyrights and other intellectual property rights to and in RecogInk.

B.    Except as otherwise permitted by law, you may not reproduce, rent, lease, sell, sublicense, assign or otherwise transfer RecogInk. You may not create derivative works based upon RecogInk or any part of RecogInk.

II. メンテナンス

A. メンテナンス: RECOGINK SOLUTIONS assumes no obligation or gives any promise to provide maintenance, technical support, or updates for RecogInk.

B. Support Services. At its sole option, RECOGINK SOLUTIONS may provide you with support services related to RECOGINK SOLUTIONS (the "Support Services"). With respect to technical information you provide to RECOGINK SOLUTIONS as part of the Support Services, RECOGINK SOLUTIONS may use such information for its business purposes, including for product support and development. RECOGINK SOLUTIONS will not utilize such technical information in a form that personally identifies you, unless required to do so by applicable law or regulation.

C. 契約の解除。他の権利を侵害することなく、RECOGINK SOLUTIONSは、契約条件に準拠しなかった場合は、この契約を解除できるものとします。

IV. 知的財産

A. Title and Copyright: RECOGINK SOLUTIONS or other parties own all title and copyrights in and to RecogInk (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into RecogInk), the accompanying printed materials, and any copies of RecogInk.
An "applet" is a specialized Java program that operates within a web page.

B. Protection: Copyright laws and international treaty provisions protect RecogInk. You must treat RecogInk like any other copyrighted material.

C. Additional Software Components: RecogInk utilizes a number of additional software components (collectively, "Additional Software Components" with their respective license). Portions of eHelp Robohelp are copyrights of Blue Sky Software Corporation; all rights reserved. Batik is copyright of Apache Software Foundation under Apache license; all rights reserved. Tomcat is copyright of Apache Software Foundation under Apache license; all rights reserved. JavaScript MD5 is copyright of Paul Johnston & Contributors under BSD license; all rights reserved. SMI Cognitive Software is copyright of SMI Cognitive Software GmbH; all rights reserved. This software is based in part on the work of Pilat Informatique Educative. All rights and title in certain products, including but not limited to copyrights, in and to Microsoft Internet Explorer are owned by the Microsoft Corporation or its suppliers. All rights and title in certain products, including but not limited to copyrights, in and to Adobe SVG Viewer are owned by the Adobe Systems Inc. or its suppliers. All rights and title in certain products, including but not limited to copyrights, in and to Java Runtime Environment are owned by the Sun Microsystems Inc. or its suppliers. Adobe SVG Viewer Logo is either a registered trademark or a trademark of Adobe Systems Incorporated in the United States and/or other countries. All other trademarks are the property of their respective owners.

You should read the complete software license for all of the Additional Software Components, which are located in the Software Component Licenses file in the Licenses directory on the installation CD and in the License directory of RecogInk. To the extent that RecogInk utilizes, incorporates or includes Additional Software Components, your use of RecogInk pursuant to this Agreement is also subject to the terms and conditions of the Software Component Licenses for the Additional Software Components that are applicable to the end-user.

V. 裁判権

A. ベルギー: If you acquired this product in Belgium, the laws of Belgium, govern this License. You agree to the jurisdiction of state courts located in Belgium in Brussels.

B. その他の国: If you acquired this product outside Belgium then local law may apply.

VI. 限定保証

A. NO WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECOGINK SOLUTIONS EXPRESSLY DISCLAIMS ANY WARRANTY FOR RECOGINK. RECOGINK SOLUTIONS PROVIDES RECOGINK AND ANY RELATED DOCUMENTATION "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. RECOGINK SOLUTIONS DOES NOT WARRANT THAT RECOGINK WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION OR BE ERROR-FREE. YOU AGREE TO ASSUME THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF RECOGINK, REGARDLESS OF WHETHER SUCH RISK WAS MADE KNOWN TO YOU.

B. NO LIABILITY FOR DAMAGES. IN NO EVENT SHALL RECOGINK SOLUTIONS OR ITS SUPPLIERS BE LIABLE FOR ANY GENERAL, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR ANY OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, PERSONAL INJURY, LOSS OF PRIVACY OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE RECOGINK, THE PROVISION OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF RECOGINK SOLUTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR PURSUANT TO DAMAGES BASED ON STRICT LIABILITY. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. HOWEVER, UNDER NO CIRCUMSTANCES SHALL RECOGINK SOLUTIONS BE RESPONSIBLE FOR DAMAGES.

VII.    雑則

A. 見出し: Headings provided in this License are for reference and convenience only and shall not be considered in the interpretation of this License.

B. 可分制: If any provision of this License is held by a court of competent jurisdiction to be contrary to law or unenforceable, then the remaining provisions shall still remain in full force and effect.
